THE WORST THING THAT EVER HAPPENED TO MEDIATION was 46 state Supreme Courts passing rules approving it. Making peace with our neighbors comes naturally enough to all of us, and learning to do so in an organized and fundamentally fair way should be acquired without any involvement from the State.
For centuries, Merchant Law controlled all disputes regarding commercial transactions, but the conquering King, wanting a taste of these fixings, created the fiction of offenses against the crown and appropriated the existing law as his own.
This sad state of affairs continues to this day. The consequence of our unwitting acquiescence to this affair is the perpetuation of the myth that, generally speaking, there are victims in our society.
